Buc-ee’s Sues Barc-ee’s for Trademark Infringement

Popular travel stop Buc-ee’s may be going back to court, suing yet another competitor for trademark infringement. A lawsuit, filed by the Texas-based company, claims that the name and logo that Missouri store Barc-ee’s uses violate Buc-ee’s rights.
By allegedly utilizing trademarks, including a smiling animal mascot, similar to Buc-ee’s, Barc-ee’s unduly benefits. Buc-ee’s claims that consumers can be easily confused and may falsely believe the two companies are related.
“Buc-ee’s will not be an idle spectator while others infringe the intellectual property rights that Buc-ee’s has worked so hard to develop,” a representative told FOX Business.
Buc-ee’s uses a logo featuring a smiling beaver centered over a yellow circle background on its stores. The same brand image also appears on a vast amount of Buc-ee’s retail products and merchandise.

The logo of Barc-ee’s is a cartoon dog riding in a pink car with a yellow circle background. Buc-ee’s says the image is a “colorful imitation” of its own brand, per USA Today. According to the company, the Barc-ee’s business concept was directly inspired by the success of Buc-ee’s.
Barc-ee’s Responds to the Buc-ee’s Trademark Lawsuit
Barc-ee’s is a coffee and food convenience store with a dog park and Western-style “mini-city.” The Marshfield, Missouri, location, which is 17 miles from a Buc-ee’s store, is currently closed.
Despite believing Barc-ee’s would prevail in court, company owner John Lopez says he probably will not challenge the lawsuit. With the sheer size of a company like Buc-ee’s, “it may not be worth the fight.”
“Although I prefer my business challenges to come with a side of coffee rather than a court summons, this is just a part of the entrepreneur game,” Lopez posted on Facebook. “My legal team believes we are not legally infringing on any trademarks.”
In January, gas station Super Fuels was called into court for allegedly using a logo very similar to Buc-ee’s. Super Fuels has a logo featuring a smiling dog in a red cape with a blue background.
In another trademark infringement suit from 2018, travel center Choke Canyon lost to Buc-ee’s. A federal court ruled that the Choke Canyon alligator logo was too similar to the Buc-ee’s beaver.
Last year, the Texas town of Luling became the home of the largest Buc-ee’s in the world. The location, which replaced a smaller Buc-ee’s, is 75,000 square feet and features 120 fueling stations.
