Arby’s Adds Potato Cakes to Permanent Menu, Will Sue Itself if It Break Promise via Pre-Class Action Lawsuit

Arby’s is bringing back a fan favorite to its menus nationwide, and it is apparently extremely serious about the permanent status attached to the returning offering.

Arby’s Potato Cakes Return for Good

According to Restaurant Business, the Atlanta-based fast-food chain is relaunching its iconic Potato Cakes as a permanent staple of the menu. In fact, Arby’s is so gung-ho about replacing the limited-time nature of the Potato Cakes’ availability with an upgrade to permanency that it’s also launched a comical — yet simultaneously quite substantive — marketing effort around the news.

Should Arby’s ever remove the Potato Cakes from menus, the chain says it will sue itself to the tune of $1 million in food, to be divided up between those who sign up for a so-called “pre-class action lawsuit” binding the company to its promise.

“Arby’s customers can now sign up to be part of the pre-class action lawsuit should Potato Cakes be removed from the menu. If removed, Arby’s will pay out $1 million dollars worth of Arby’s food to be split amongst the signees. No menu item return has ever been this ironclad,” the chain stated, according to Eat This, Not That!

Those particularly fond of Arby’s — or of collecting on free food should the chain renege on its promise — can sign up at www.arbyspotatocakeslawsuit.com, or by calling the amusingly issued phone number of 1-833-LAW-SPUD (1-833-529-7783).

There are further benefits to signing up for the pre-class action lawsuit, however. Those who add their name to the register will also find themselves in possession of a DoorDash code offering free delivery and a free two-piece Potato Cakes at any time between Feb. 27 and Mar. 5, 2025.

Social media users on Instagram seemed fairly enthusiastic over the return of the hashbrown-like Arby’s treat. Comments attached to a Feb. 24 post highlighting the news were largely positive.

“They never should’ve left! They’re part of Arby’s identity,” one user wrote.

“Arby’s, DO NOT play with our emotions. Did 2/24/25 just become the BEST day EVER?!?” a second gushed.
