Court rules in favor of AmEx’s ‘anti-steering’ provisions

Retailers commonly set shelves to direct shoppers toward certain products that may be more profitable, but according to a federal court of appeals, American Express can ban their retail customers from steering shoppers toward credit cards that charge lower transaction fees. The appeals court overturned a judgment made in February of 2015 that ruled in favor of the plaintiffs, finding the “non-discrimination provisions (NDP)” included in AmEx’s merchant agreement run counter to accepted business practices.
