Poppi Soda Sued After Claims of Consumer Fraud

June 4, 2024

The popular soft drink Poppi is facing a lawsuit over deceptive advertising claims.

Plaintiff Kristin Cobbs of San Francisco filed the class action lawsuit Wednesday on behalf of herself and “similarly situated” consumers of Poppi against its parent company, VNGR Beverage LLC. The lawsuit claims the Austin, Texas-based company “committed acts of false and misleading advertising.”

The lawsuit claims that the soft drink does not “provide meaningful prebiotic effects” as advertised. It states, “Accordingly, a consumer would need to drink more than four Poppi sodas daily to realize any potential health benefits from its prebiotic fiber. However, even if a consumer were to do this, Poppi’s high sugar content would offset most, if not all, of these purported gut health benefits.”

Poppi discussed the suit in a statement to USA Today. Their remarks deny any claims made by the plaintiff.

“We are proud of the Poppi brand and stand behind our products,” the company stated. “We are on a mission to revolutionize soda for the next generation of soda drinkers, and we have diligently innovated to provide a tasting experience that millions of people have come to enjoy. We believe the lawsuit is baseless, and we will vigorously defend against these allegations.”

The Poppi website shares the healthful benefits of the product. It states that the beverage combines fruit juice, apple cider vinegar, and inulin prebiotics. Subsequently, many celebrities have publicized the brand, adding to its credibility, including Post Malone, Hailey Bieber, Kylie Jenner, Billie Eilish, Russell Westbrook, Jennifer Lopez, and Olivia Munn.

Poppi came to public consciousness after being featured on “Shark Tank.” The product was supported by entrepreneur Rohan Oza, the beverage brand business dynamo behind Vitamin Water, Vita Coco, and Bai products.

The website Food Republic reports that the company, formerly Mother Beverage, accepted Oza’s offer of $400,000 in exchange for a 25% stake in the company. Poppi is available at stores such as Target, Whole Foods, Publix, and H.E.B. In a video clip showing how the brand has grown since its initial “Shark Tank” appearance, Oza said, “I love the brand so much that I’ve doubled my investment.”
