FDA Rescinds Marketing Ban on JUUL Vaping Products

The FDA has rescinded a marketing ban on JUUL vaping products, effective Thursday, June 6, 2024. This could allow for possible authorization of its products in the future, according to ABC News.

The Food and Drug Administration has paused a block against the product that it put in place in 2022 to conduct additional scientific reviews. At that time, the FDA “determined that the applications lacked sufficient evidence regarding the toxicological profile of the products to demonstrate that the marketing of the products met the public health standard required by law.”

The statement explains that “Rescission of the MDOs returns the applications to pending status, under substantive review by the FDA. The FDA’s regulations significantly limit what the agency can disclose regarding the content of pending applications.”

“The agency’s continued review does not alter the fact that all e-cigarette products, including those made by JUUL, are required by law to have FDA authorization to be legally marketed,” it concludes.

In 2022, the FDA banned JUUL from selling and marketing its e-cigarette products. This was after JUUL was unable to prove that keeping its products on the market “would be appropriate for the protection of the public health.”

A statement by the American Lung Association, reprinted by CNN, shares how the health organization is unhappy with this current decision.

Erika Sward, the association’s assistant vice president of nationwide advocacy, said, “The Lung Association is deeply troubled that the marketing denial orders for JUUL have been rescinded and urge FDA to issue marketing denial orders for all of its products. JUUL is largely responsible for the youth e-cigarette epidemic from 2017-2019.”

It continues, “These products and its manufacturer clearly do not meet the standard for protecting the public health. FDA must follow the law and not permit any JUUL product or other tobacco product to be sold in the U.S. prior to it receiving a premarket authorization.”

Per ABC News, JUUL’s original applications “lacked sufficient evidence regarding the toxicological profile of the products to demonstrate that the marketing of the products met the public health standard required by law.” Juul Labs subsequently stated that they “appreciate the FDA’s decision and now look forward to re-engaging with the agency on a science- and evidence-based process to pursue a marketing authorization for JUUL products.”

The official JUUL website states that its products are for smokers 21 and older. It reads, “Our core mission to eliminate combustible cigarettes is not achievable without ensuring those who have never used nicotine never start.”
